Getting regulation right is just as important as getting the tech right
Artificial Intelligence is transforming healthcare at a pace few industries have seen. The global AI in healthcare market was valued at nearly $30 billion in 2024 and is projected to reach over $500 billion by 2032[1]. From faster radiology reads to real-time patient monitoring, the clinical case for AI-enabled medical technology has never been stronger, and the pressure to deliver has never been greater.
Clinician shortages, mounting backlogs and rising costs are pushing healthcare systems to their limits. New MHRA guidance in the UK continues to redefine what qualifies as a Software as a Medical Device (SaMD), and in the US the FDA has openly acknowledged that its traditional device regulation model wasn’t designed for adaptive AI.
The result is a compliance landscape that is genuinely complex, constantly evolving and carries serious consequences when misread. A poorly judged regulatory strategy can delay market entry by months or even years, inflate development costs significantly or even result in device withdrawal after launch. In addition to this, there are the technical considerations: data governance, cybersecurity vulnerabilities, AI model validation and the very specific skills required to manage all of it properly.
Beyond the code: what AI compliance actually demands
One of the most common and costly mistakes in this space is underestimating just how different SaMD development is from conventional software engineering. A machine learning model that performs well on initial data may not hold up under real-world clinical conditions. Updating an AI model with new field data, that is standard practice in most software environments, can trigger re-validation requirements in the medical sector that teams simply aren’t prepared for.
Developing an AI-enabled medical device demands a genuinely cross-disciplinary team: Machine Learning engineers, risk management specialists, User eXperience designers with compliance experience, cybersecurity experts and regulatory consultants who understand both the technology and the shifting international rulebooks.
Add to this the question of which market to enter first and the fact that the US, EU and UK each have different classification rules, timelines and evidence requirements, and the picture becomes clear: this isn’t a space where compliance can be an afterthought.
